Terms of Service

You must be at least 18 years old to use Kreatrix. By using the Service, you represent that you meet this age requirement.

You agree to use Kreatrix only for lawful purposes and in accordance with these Terms. You are responsible for all activity that occurs under your account.

You must provide accurate and complete information when creating an account and keep your login credentials secure. You agree to notify us immediately of any unauthorized use of your account.

When using Kreatrix, you agree NOT to:

• Generate, upload, or share content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Create content depicting minors in any inappropriate or harmful context
• Generate non-consensual intimate imagery of real people
• Create deepfakes or synthetic media intended to deceive, defraud, or harm others
• Violate any applicable laws, including intellectual property and privacy laws
• Attempt to bypass, disable, or interfere with security features of the Service
• Use the Service to send spam, phishing, or malicious content
• Reverse engineer, decompile, or attempt to extract source code from our Service
• Use automated systems (bots, scrapers) without our written permission
• Resell, sublicense, or redistribute the Service without authorization

Your Content

You retain ownership of any original content you upload to Kreatrix ("User Content"). By uploading content, you represent that you have the necessary rights to use and share that content.

Generated Content

Content generated using our AI tools ("Generated Content") is owned by you, subject to the following:

• You have commercial rights to Generated Content created under paid subscription plans
• Free tier users receive limited commercial rights; see our pricing page for details
• You are responsible for ensuring Generated Content does not infringe third-party rights
• AI-generated content may be subject to third-party model provider terms

Platform Content

Kreatrix and its licensors own all rights in the Service, including our logo, trademarks, software, and documentation. These Terms do not grant you any rights to use our branding without permission.

By uploading User Content or creating Generated Content, you grant Kreatrix a worldwide, non-exclusive, royalty-free license to:

• Host, store, cache, and back up your content
• Process your content through AI models to provide the Service
• Display your content to you and users you choose to share with
• Create thumbnails and previews for platform functionality

This license is solely for the purpose of operating and improving the Service. We do not claim ownership of your content and will not sell or monetize it without your explicit consent.

We respect intellectual property rights and comply with the Digital Millennium Copyright Act (DMCA). If you believe content on Kreatrix infringes your copyright, please see our Content Policy for takedown procedures.

Repeat infringers may have their accounts terminated at our discretion.

To the maximum extent permitted by law:

Kreatrix and its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, revenue, or data
• Business interruption
• Cost of substitute services
• Any damages arising from your use of the Service or inability to use the Service

Our total liability for any claim arising from or related to these Terms or the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or $100 USD, whichever is greater.

The Service is provided "as is" and "as available" without warranties of any kind.

We expressly disclaim all warranties, whether express, implied, or statutory, including but not limited to:

• Merchantability and fitness for a particular purpose
• Non-infringement
• Accuracy, reliability, or completeness of content
• Uninterrupted or error-free operation
• Security of your data or account

AI-generated outputs may contain errors, biases, or unexpected results. You are solely responsible for reviewing and validating Generated Content before use.

You may terminate your account at any time by contacting us or using account settings (where available).

We may suspend or terminate your access to the Service at our sole discretion, without notice, if:

• You violate these Terms or our Acceptable Use Policy
• Your use poses a security risk to us or other users
• We are required to do so by law
• We discontinue the Service (with reasonable notice where possible)

Upon termination, your right to use the Service ceases immediately. We may delete your account data after a reasonable retention period unless required by law to retain it longer.

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration administered by JAMS under its Comprehensive Arbitration Rules. The arbitration shall take place in Los Angeles County, California.

You agree to waive any right to participate in a class action lawsuit or class-wide arbitration against Kreatrix.

We may update these Terms from time to time. When we make material changes, we will notify you by posting the updated Terms on this page and updating the "Last Updated" date.

Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If you do not agree to the changes, you should stop using the Service.
